Waiver and Release of Liability

Jeanne Marie Fitness, LLC provides online fitness and nutrition coaching, including providing exercise plans and nutrition menus.

In consideration of the risk of injury while using this service, and as a consideration for the right to use this service I, hereby for myself, my heirs, executors, assigns, and personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights claims or causes of actions of any kind whatsoever arising out of my using the service provided by Jeanne Marie Fitness, LLC, and do here by release and forever discharge Jeanne Marie Fitness, LLC, their affiliates, managers, members, agents, attorneys, staff, etc…, for any physical or psychological injury including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my using the services of Jeanne Marie Fitness, LLC. 

I am voluntarily using the services of Jeanne Marie Fitness, LLC, and I am using this service entirely at my own risk. I am aware of the risks associated with using the services of Jeanne Marie Fitness, LLC, which may include but are not limited to physical or psychological injury, pain, suffering, illness, temporary or permanent disability, economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others negligence, or the conditions of the activity, but none the less, I assume all risks, both known to me or unknown to me, for my use of this service.

I agree to indemnify and hold harmless Jeanne Marie Fitness, LLC against any and all claims, suits, or actions of any kind whatsoever, for liability, damages, compensation, or otherwise, brought by me or anyone on my behalf, including attorney’s fees and related costs. I acknowledge that Jeanne Marie Fitness, LLC and their directors, officers, volunteers, representatives, and agents, are not responsible for errors, omissions, acts, or failure to act, of any party or entity working on behalf of Jeanne Marie Fitness, LLC.

I acknowledge that use of the services of Jeanne Marie Fitness, LLC may involve a test of a person's physical and mental limits and may carry with it a potential for death, serious injury, property loss, and the risk may include, but are not limited to, those caused by the facilities, temperature, weather, lack of hydration, condition of participants, and equipment. Jeanne Marie is not a doctor or registered dietician and her suggestions are not intended to be used to treat, care or prevent any health problem nor is it intended to replace the advice of a physician.

I acknowledge that I have carefully read this Waiver and Release, and fully understand that it is a release of liability. I expressly agree to release and discharge Jeanne Marie Fitness, LLC and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, representatives, predecessors, successors and assigns, from any and all claims or causes of actions, and I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against JmarieFitness.com for personal injury or property damage.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Jeanne Marie Fitness, LLC or its agents in its employees.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

In the event that any damage to equipment or facilities occurs as a result of my willful actions neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of negligence or recklessness.
I also acknowledge that there are no refunds, returns, or exchanges. Once I made my purchase, the transaction was finalized and I am held financially responsible for my purchase. Any attempt to return or request refund will result in legal action taken against me.

It is my responsibility to check in with Jeanne Marie, as she will not initiate contact after the initial email. I am responsible for sending my weekly check in’s, on time and failure to do so will result in loss of coaching, with no refund.

App and instagram access are only for the length of your coaching plan.

Jeanne Marie has the right to refuse service to anyone.

There are no refunds, returns or exchanges upon purchase and proceeding with my purchase ensures that I understand those conditions. Legal actions will ensue if refunds are requested via any method. 
I, the applicant for this Waiver and Release of Liability, warrant and represent that I understand and accept this Waiver and Release of Liability.
